Texas DWI – Penalties
Charge: Driving While Intoxicated: First Offense
Classification: Class B misdemeanor
Penalty: No more than 180 days in county jail and/or a fine not to exceed $2,000
Charge: Driving While Intoxicated: Second Offense
Classification: Class A misdemeanor
Penalty: No more than one year in county jail and/or a fine not to exceed $4,000
